General Terms & Conditions (GTC)

GTC for the Steiff Online Shop EU

§ 1 Scope of application:

These General Terms and Conditions shall apply to all mutual claims arising from and in connection with the conclusion of a contract for this online shop between you and Magarete Steiff GmbH, Richard-Steiff-Str. 4, D-89537 Giengen/Brenz (hereinafter referred to as "Steiff" ).

§ 2 Delivery/Prices/Shipping costs (hereinafter referred to as "Delivery Countries")

(1) We deliver to the following countries:

Germany, Austria, Great Britain, France, Belgium, Netherlands, Luxembourg, Spain, Portugal, Estonia, Finland, Greece, Ireland, Italy, Latvia, Lithuania, Slovakia and Slovenia. Deliveries to other countries are not possible. Delivery is carried out with DHL or UPS and is made from Germany. The delivery times are the days listed below to the corresponding Delivery Country.

  • 2 -3 days: Germany, Austria, Belgium, Netherlands, Luxembourg
  • 3 -4 days: Estonia, Ireland, Italy, Latvia, Lithuania, Slovakia, Slovenia
  • 3 -6 days: France
  • 4 -5 days: Spain, Portugal
  • 4 -6 days: United Kingdom, Finland
  • 6 -8 days: Greece

(2) All prices are total prices in Euro or English pounds, i.e. they include all price components as well as the statutory value added tax.

In addition to the indicated prices, we charge the following shipping costs to the respective Delivery Country for each order:

For orders from the Online Shop EU:

  • Delivery to : Belgium, Netherlands, Luxembourg, Estonia, Ireland, Italy, Latvia, Lithuania, Slovakia, Slovenia, France, Spain, Finland € 7.95
  • Delivery to Greece and Portugal: € 19.95

(3) Returns from Germany and Austria are free of charge. In the case of returns from other Delivery Countries as those mentioned in section 2 (1), the customer bears the return costs itself.

§ 3 Conclusion of contract/contract language/correction of input errors

The presentation of the articles is not a legally binding offer, but an invitation to you to submit a binding offer to us. You can submit this offer in the online shop by placing the desired items in the virtual shopping cart (click on the button "Add to cart" and "Checkout") and sending us the items placed in the shopping cart (click on the button "Buy now"). After receipt of the order in the online shop, you will automatically receive an e-mail documenting your submitted offer (order). This e-mail merely confirms that we have received the order; a contract is not yet concluded.

An effective contract is only concluded when we accept your offer by requesting payment after placing the order, by sending an order confirmation by e-mail or telephone or by delivering the goods within 5 days. When ordering via our online shop, the ordering process comprises a total of four steps. In the first step you select the desired goods. In the second step, you enter your customer data including billing address and, if necessary, a different delivery address. In the third step you choose how you want to pay. In the last step you will first be informed about our General Terms and Conditions, the cancellation policy and the sample cancellation form and then have the opportunity to check all details (e.g. name, address, method of payment, items ordered) once again and correct them if necessary before you send your order to us by clicking on "Buy now".

The contract is concluded exclusively in english language.

You can correct input errors before sending your order with the technical means provided in the online shop as well as with the usual functions of your keyboard/mouse. You can also cancel the process at any time by closing the browser window. By clicking the "Buy now" button you have submitted a binding offer (order); input errors cannot be corrected afterwards.

§ 4 Terms of payment

The payment methods available to you please refer to the following list depending on your billing country:

PayPal (all delivery countries)

You pay directly via your PayPal account. After submitting your order, you will be redirected to PayPal and approve the order value there. The payment is made immediately using the payment method selected by PayPal.

Credit card (VISA/MasterCard) (all delivery countries)

Your credit card will be charged when the ordered goods are shipped.

Purchase on account Ratepay (only in DE, A, CH and NL)

The purchase on account takes place via Ratepay GmbH, a payment service provider for online purchases. You do not need to open an account or become a member. If you have selected payment by invoice with Ratepay, payments with debt-discharging effect can only be made to Ratepay. Payment within 14 days from the date of invoice. A cash discount is not possible. Please understand that Ratepay reserves the right to require prepayment of your goods or cash on delivery payment in order to hedge the credit risk in case of a corresponding bonus. In such cases, Ratepay will contact you prior to the conclusion of the contract to agree on the procedure. Further details can be found in the Ratepay Terms of Payment as well as in the Ratepay Privacy Policy.

Immediate bank transfer (only in DE/A)

The payment is made via the payment service provider SOFORT GmbH. After submitting your order you will be redirected to IMMEDIATE bank transfer and instruct them to make the payment via your online banking account (PIN/TAN). The execution of the payment and the debit of your account will be carried out immediately after the assignment of SOFORT GmbH.

§ 5 Cancellation policy for consumers

Right of withdrawal:

You have the right to withdraw from this contract within 14 days without giving reasons. The revocation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took or has taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by regular mail or e-mail sent by post) of your decision to withdraw from this contract. The address for exercising the right of withdrawal is as follows:

You can use the attached sample revocation form, which is not mandatory.

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of withdrawal before the end of the revocation period.

Consequences of revocation:

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery charges (except for any additional costs arising from the fact that you have chosen a different method of delivery to the cheapest standard delivery offered by us), without delay and at the latest within 14 days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you, and in no event will you be charged for this refund.

We may refuse a refund until we have received the goods back or until you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without delay and in any case within 14 days at the latest from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired.

You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary for the purpose of checking their nature, properties and functioning.

Exclusion of the right of withdrawal:

According to Section 312g para. 2 of the German Civil Code (BGB) the right of withdrawal does not apply to the following contracts:

Contracts for the supply of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (Section 312g para. 2 no. 1 BGB), contracts for the supply of newspapers, journals or magazines with the exception of subscription contracts (Section 312g para. 2 no. 7 BGB).

§ 7 Storage of contract text

The text of the contract will be stored by us and sent to you by e-mail immediately after sending your offer to conclude a purchase contract together with the General Terms and Conditions. You can also print out the order data immediately after sending it. It is no longer possible to call up the goods after the order process has been completed.

§ 8 Information on Online Dispute Resolution

The EU Commission has created an Internet platform for the online settlement of disputes (so-called "OS platform"). The OS platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. § 9 Applicable law and place of jurisdiction

The legal relationship between Steiff Retail GmbH and you shall be subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws provisions. In the case of consumers, this choice of law only applies insofar as the protection of the law of the state in which the consumer has his/her habitual residence, which is granted by mandatory provisions, is not withdrawn.

The place of jurisdiction shall be the court responsible for the registered office of Steiff Retail GmbH, provided that the buyer is a merchant or a legal entity under public law or a special fund under public law. The same applies if the customer does not have a general place of jurisdiction in Germany or the EU, or if his/her place of residence or usual abode is not known at the time the action is filed. The right to also call upon the court at another legal place of jurisdiction remains unaffected by this.

We prefer to clarify your concerns in direct communication with you and therefore do not participate in dispute resolution proceedings before a consumer arbitration board.
